Camden County Prosecutor Vincent P. Sarubbi reported that a Grand Jury indicted a Clementon man today on a charge of Endangering the Welfare of the Elderly, accusing him of neglecting his 88-year-old mother.

Clementon Police charged Theodore J. Stinsman, 58, of Wauseon Avenue, after emergency medical personnel and officers responded to a 911 call on Aug. 1, 2004, and found the victim, Alice Mae Stinsman, lying in a bed in the home. Her clothing was soiled and the room was infested with insects. The third-degree charge, which carries a maximum prison term of five years upon conviction, alleges that Theodore Stinsman subjected his mother to unreasonable neglect by failing to perform an act necessary for the physical or mental health of a person 60 or older.

Alice Stinsman was taken to Kennedy Memorial Hospital in Stratford, where she remained until being transferred to Stratford Nursing & Convalescent Center several days later. She died at the nursing home on Oct. 14, 2004. The attending physician ruled her death to be due to natural causes.

Sarubbi commended Clementon Police, under the direction of Chief William Malseed, and in particular Detective Charles Glover, the lead investigator on the case, for their professional handling of the investigation.

"New Jersey law is clear that a person who has assumed continuing responsibility for the care of an elderly person has the legal duty to perform acts necessary for the elderly person's physical and mental health, or provide for someone else to perform those acts," Sarubbi explained. "There are numerous services available to help people care for an elderly person if help is needed."

Sarubbi noted that each of New Jersey's 21 counties has an Office on Aging that coordinates services for elderly residents.

"No elderly or disabled person should have to suffer because of neglect," Sarubbi said.

No court dates have been scheduled for Stinsman at this time. An initial appearance is expected to be scheduled in the coming weeks.

All persons charged with criminal offenses are presumed innocent unless and until proven guilty in a court of law.
