Camden County Prosecutor Vincent P. Sarubbi, New Jersey Treasurer
John E. McCormac and Cherry Hill Police Chief Brian Malloy announced
that Jeffre and Cynthia Levy, of Henfield Avenue in Cherry Hill,
were charged today with Theft and violations of state tax law. They
are accused of keeping more than $150,000 in sales and income tax
proceeds from their janitorial companies and failing to forward
the money to the state as required.
Criminal complaints allege that between Jan. 1, 1994, and Dec. 31,
2001, the defendants failed to pay state income taxes they withheld
from employees and sales taxes they collected from customers of
their companies - Executive Maintenance Co., Executive Maintenance
Inc. and Executive Maintenance Industries Inc. The companies, all
based in Cherry Hill, were owned either by Jeffre, M/41, by Cynthia,
F/47, or by both. The defendants currently own and operate Scarlet
Facilities Maintenance LLC, also of Cherry Hill.
The Levys face two second-degree charges, each carrying a maximum
10 years in New Jersey State Prison upon conviction, and one third-degree
charge, carrying a maximum five-year term.
Sarubbi thanked the state Division of Taxation's Office of Criminal
Investigation for assisting in the investigation.
The defendants, accompanied by their attorney, Adam Malamut, turned
themselves in today at Cherry Hill Police headquarters. They were
released on summonses.
All persons charged with criminal offenses are presumed innocent
unless and until proven guilty in a court of law.
