Camden County Prosecutor Vincent P. Sarubbi and New Jersey Division
of Criminal Justice Director Vaughn L. McKoy announced today that
a Grand Jury indicted Edward Forchion, M/39, on Thursday, Jan. 8,
2004, on one count of Criminal Contempt for allegedly refusing to
submit a DNA sample for a statewide data bank.
A hearing for Forchion, of Pemberton Township, N.J., is scheduled
in state Superior Court in Camden on Monday, Jan. 12, 2004, at approximately
9 a.m. before Judge Robert G. Millenky in Courtroom 46 of the Camden
County Hall of Justice, 5th Street and Mickle Boulevard, Camden, N.J.
If convicted, Forchion faces up to 18 months in prison on the fourth-degree
charge.
The indictment alleges that Forchion purposely or knowingly disobeyed
a judicial order to submit a DNA sample to be submitted for inclusion
in a statewide DNA data bank overseen by the state Division of Criminal
Justice. The order stemmed from Forchion's December 2000 conviction
for Possession with Intent to Distribute Marijuana.
All persons charged with criminal offenses are presumed innocent unless
and until proven guilty in a court of law.
